Terms of Service

These terms govern your use of the ihomepage.net website and the information published on it. Please read them before using the site.

Please note: these terms cover this public website only. If you subscribe to the iHomepage CMS platform, a separate service agreement will govern that subscription, and in the event of a conflict that agreement takes precedence for the platform.

1. Acceptance of terms

By accessing or using ihomepage.net (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Site. If you use the Site on behalf of an organisation, you represent that you have authority to bind that organisation, and "you" refers to both you and that organisation.

2. Who we are

The Site is operated by BODA High-Tech Computer Inc., a California corporation with its registered office at 919 Fremont Ave, Alhambra, CA 91803, United States ("we", "us", "our"). We develop and operate the iHomepage CMS website building platform.

3. What this website provides

The Site presents information about iHomepage CMS, including product descriptions, template previews, articles and company information. It is provided for general informational purposes. Nothing on the Site constitutes a binding offer, professional advice, or a guarantee of any particular result — including any specific search engine ranking, traffic volume, or commercial outcome.

Figures such as the number of available templates, and any illustrative previews, are indicative and may change without notice.

4. Permitted use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and view the Site for your own internal business or personal evaluation purposes. You may print or download individual pages for that purpose, provided you keep all copyright and proprietary notices intact.

5. Prohibited conduct

You agree not to:

  • Use the Site in any way that breaches applicable law or regulation;
  • Copy, reproduce, republish, sell, rent or sub-licence any part of the Site except as permitted in section 4;
  • Use automated means — including scrapers, crawlers or bots — to access, extract or index the Site in a manner that imposes an unreasonable load on our infrastructure, or that circumvents any technical restriction;
  • Attempt to gain unauthorised access to the Site, its servers, or any connected system or network;
  • Introduce malware, or otherwise interfere with the proper operation or security of the Site;
  • Reverse engineer, decompile or disassemble any part of the Site, except to the extent this restriction is prohibited by applicable law;
  • Remove, obscure or alter any proprietary notice;
  • Use the Site to send unsolicited communications, or to collect personal information about other users.

We may suspend or terminate your access to the Site at any time, without notice, if we reasonably believe you have breached these Terms.

6. Intellectual property

The Site and all of its contents — including text, graphics, layouts, illustrations, logos, icons, software and the selection and arrangement thereof — are owned by us or our licensors and are protected by copyright, trademark and other intellectual property laws. "iHomepage", "iHomepage CMS" and our logo are trademarks of BODA High-Tech Computer Inc. Except as expressly stated in these Terms, no right or licence is granted to you.

7. Templates and previews

Template names, previews and illustrations shown on the Site are provided to demonstrate structure and layout. They may use placeholder text, generic company names and illustrative graphics that are not included with, or are not representative of, any final product. Any resemblance of a placeholder name to a real organisation is coincidental.

Rights to use a template within the iHomepage CMS platform are granted under the applicable platform service agreement, not by these Terms. Nothing on this Site grants a right to extract, reuse or redistribute template designs outside the platform.

8. Your submissions

If you send us an inquiry, feedback, suggestion or other material ("Submission"), you confirm that it is your own or that you have the right to send it, and that it does not contain confidential information of a third party, unlawful content, or malicious code.

You grant us a non-exclusive, worldwide, royalty-free, perpetual licence to use, reproduce and adapt Submissions for the purpose of responding to you and improving our products and services. We are under no obligation to keep Submissions confidential, to compensate you for them, or to act on them. If you submit ideas or suggestions, we may implement similar features without any obligation to you.

You are responsible for the accuracy of any information you provide, and for keeping it lawful and free of sensitive personal data.

9. Third-party links and services

The Site may link to third-party websites or embed third-party services (for example web fonts, content delivery networks and, with your consent, web analytics). We do not control those parties and are not responsible for their content, availability, practices or policies. Links are provided for convenience and do not imply endorsement. Your use of a third-party service is governed by that party's own terms.

10. Availability and changes

We aim to keep the Site available, but we do not guarantee uninterrupted or error-free access. We may modify, suspend or discontinue any part of the Site, and may change these Terms, at any time. Where we change these Terms materially, we will update the "Last updated" date and, where appropriate, provide a more prominent notice. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

11. Disclaimer of warranties

To the fullest extent permitted by law, the Site and all content are provided "as is" and "as available", without warranty of any kind, whether express, implied or statutory — including implied warranties of merchantability, fitness for a particular purpose, title, accuracy and non-infringement. We do not warrant that the Site will be secure, uninterrupted, free of errors or viruses, or that any information on it is complete, current or accurate.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you. Nothing in these Terms limits rights you have as a consumer that cannot be limited by law.

12. Limitation of liability

To the fullest extent permitted by law, we and our directors, officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, business, goodwill or anticipated savings, arising out of or in connection with your use of, or inability to use, the Site — whether based on contract, tort (including negligence), strict liability or any other theory, and even if we have been advised of the possibility of such damages.

Our total aggregate liability arising out of or relating to the Site is limited to one hundred US dollars (USD 100).

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.

13. Indemnity

You agree to indemnify and hold harmless BODA High-Tech Computer Inc. and its directors, officers and employees from any claim, demand, loss, liability or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Site, or your violation of any law or third-party right.

14. Privacy and cookies

Our handling of personal information is described in our Privacy Policy, and our use of cookies is described in our Cookie Policy. Both form part of your use of the Site.

15. Governing law and disputes

These Terms and any dispute arising out of or in connection with them or the Site are governed by the laws of the State of California, United States, without regard to its conflict of law rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California, and waive any objection to venue in those courts.

If you are a consumer resident in the European Economic Area or the United Kingdom, this choice of law does not deprive you of the protection of mandatory consumer provisions of the law of your country of residence, and you may bring proceedings in your local courts where applicable law so provides.

16. General

  • Entire agreement: these Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and us regarding the Site.
  • Severability: if any provision is held unenforceable, the remaining provisions continue in full force, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
  • No waiver: our failure to enforce a provision is not a waiver of our right to do so later.
  • Assignment: you may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition or sale of assets.
  • No third-party beneficiaries: these Terms create no rights for any person other than you and us.
  • Force majeure: we are not liable for failures caused by events beyond our reasonable control.
